By entering the AvPlan EFB at Avalon 2023 Photography Competition (The Competition), you warrant that you have read, understood, and agree to, the following Terms and Conditions:
The Competition
The Competition is a photography competition.
The Competition is organised and promoted by AvSoft Australia Pty Ltd ABN: 83 165 763 468 (The Competition Organiser) 23 Second Avenue, Moorabbin Airport, Victoria, 3194, Australia, also referred to as AvPlan EFB.
All information on ‘How to Enter’ forms part of these terms and conditions.
The Competition commences on Tuesday 28 February 2023 at 09.00am AEDT and closes on Sunday 5 March 2023 at midnight AEDT (Competition Period). Any entry that is not received during The Competition Period will be invalid.
Entrant Eligibility
Entrants must be aged 18 or over at the time of submitting an entry.
Entrants must be a Permanent Resident of Australia or New Zealand.
Entrants must be individuals and not companies or other entities.
Entrants must not be an employee of AvSoft Australia Pty Ltd.
AvSoft Australia reserves the right to request proof of eligibility.
Theme of an Entry
The creative theme of a photograph entry must be ‘AvPlan EFB at Avalon 2023’ (The Theme). AvSoft Australia reserves the right to decide if an entry has adopted the theme appropriately and thereby addresses part of the eligibility criteria below.
Entry Eligibility
Any photograph entered (The Entry) in The Competition must include the front cover of the “AvPlan EFB at Avalon 2023 Photography Competition Board” (The Competition Board) shown below and obtained from the AvPlan EFB stand (Exhibition Hall 2) at Avalon Airshow, showcased in the photograph’s content:
The entry must address The Theme.
The entry must be an original photograph. Basic editing, ie cropping, contrast/brightness adjustments, conversion to black and white, etc, are acceptable, however, NO commercial filtering or photoshopping allowed! AvSoft Australia reserves the right to deem a photograph unacceptably altered or edited.
The entry must be taken during The Competition Period.
The entry must be taken within the grounds of the Avalon 2023 Australian International Airshow Aerospace and Defence Exhibition, at Avalon Airport, Geelong, Victoria, Australia.
The entry must be owned by the submitting photographer.
The entry must be posted to social media, and, the post must tag AvPlan EFB on the selected social media and include the hashtags #AvPlanEFB and #Avalon2023.
The entry must not be branded or watermarked.
About entering
Enter as many times as you like but be careful not to upset the relevant Social Media site platform rules. Especially DO NOT retweet or share your own image, or encourage others to do so: excessive sharing may result in the social media platform blocking your post. Each photograph is ONLY one entry and all entries will be considered individually. No repost/retweet/reshare will be considered a separate entry.
To create an eligible photograph and entry, entrants must complete the following 3 steps:
1. TAKE A PHOTOGRAPH that showcases the “Avplan EFB iPad Competition Entry Board” (in keeping with The Theme “AvPlan EFB at Avalon 2023”) at the Avalon 2023 Australian International Airshow Aerospace and Defence Exhibition, at Avalon Airport, Geelong, Victoria, Australia, during the Competition Period.
2. POST THE PHOTOGRAPH to any or all of the following social media and tag AvPlan EFB. Facebook: by tagging @AvplanEFB, LinkedIn: by tagging @AvplanEFB, Twitter: by tagging @AvplanEFB, Instagram: by tagging @Avplan_EFB.
3. AND use BOTH the following hashtags on the post: #AvplanEFB and #Avalon2023.
NOTE: Any entry NOT completing 1, 2, and 3 of the above process will be automatically deemed ineligible.
Entries NOT received by the Competition Organiser
AvSoft Australia accepts no responsibility for any entries not received for any reason during the Competition Period. No responsibility will be taken for lost, late, or misdirected entries. AvSoft Australia is not responsible for technical difficulties with the entry mechanism and cannot guarantee that the entry mechanism will be available at all times. If you are concerned that your image has not posted successfully, please contact competition@avsoft.com.au prior to close of the Competition Period – enquiries received after the end of the Competition Period will not be considered.
Social Media Use
The Competition Organiser is not responsible for any unauthorised use, access, theft, or distribution, of any entries that have been posted to social media. The Competition Organiser will not be liable for any use of the social media entry by any third party. The Entrant agrees that the Competition Organiser is under no obligation to use or promote the Entry. The Entrant also agrees not to acquire, download, affect, or otherwise use, other entrant’s entries.
Unacceptable or ineligible entries
Upon viewing an entry posted on social media, AvSoft Australia reserves the right to repost, release, or refuse to use, the image on its social media pages. AvSoft Australia also reserves the right to accept, hide, or remove its social media tag on a photograph’s post.
Any entry that does not include the iPad side of the “AvPlan EFB at Avalon 2023 iPad Competition Board”, or is deemed by AvSoft Australia as photoshopped, unduly edited, inappropriate, containing offensive or defamatory imagery, not aligned with the designated Theme, or which breaches any law or infringes any third-party rights, including intellectual property rights, will not be eligible to win.
By entering The Competition, you expressly warrant that copyright of the photograph you have entered is yours. AvSoft Australia expressly warrants that it does not accept any responsibility for the copyright of an entry. If an entrant enters an image that is not theirs to enter, the legal responsibility for a breach of copyright shall lie with the entrant.
Judging
Judging of eligible entries, by a nominated AvPlan EFB team, will take place on Tuesday 7th March 2023 and one winner will be announced via AvSoft Australia’s Social Media pages (LinkedIn, Twitter, Facebook, and Instagram) on Wednesday 8th March 2023.
Our judging team’s decision is final! Nope, no arguments!
Only One Winner
The winning photograph (The Winner) will be selected from the eligible entries, on the creativity and merit of the entry to the designated theme, as judged by the team.
The Winner will be contacted via Social Media post (@mention), and the winner is required to claim their prize by directly contacting AvSoft Australia, either via email (competition@avsoft.com.au) or by phone AU +61 3 8370 3024 (0030 UTC to 0730 UTC Monday to Friday business days).
Every reasonable effort will be made by AvSoft Australia to contact The Winner, however, should The Winner not respond to contact requests or claim the prize within three (3) months of the close of the Competition Period (i.e. by 5pm 5 June 2023), the prize will be forfeited.
Personal information and AvSoft Australia’s use of your photograph
What we do with your info and your entry!
By entering The Competition, you agree to AvSoft Australia (as AvPlan EFB) responding to your photo entry on social media. You also agree to AvSoft Australia’s reasonable use of The Entry to repost/reshare/retweet, or otherwise use, in relation to the Competition.
AvSoft Australia will respect the author’s moral right of attribution for the Winning Photograph.
By entering The Competition, you grant to AvSoft Australia on submission of any photograph entry (The Material), a royalty-free, non-exclusive and irrevocable licence to use, reproduce and communicate to the public The Material for the purposes of the AvPlan EFB at Avalon 2023 iPad Competition.
If your photograph is judged to be the winning photograph (The Winning Photograph), you further agree to AvSoft Australia contacting you regarding the prize, and to collecting your personal information, including your name, email address, and telephone number, for the purposes of despatching the prize to you. AvSoft Australia expressly warrants that these personal details shall not be disseminated or used for promotion, for advertising, or given to any other party, except as follows: As The Winner of The Competition, you consent to the disclosure, publication and dissemination of your name and likeness for the purposes of The Competition, and AvSoft Australia’s advertising and marketing purposes.
The Winner further agrees that the Winning Photograph may be reasonably used by AvSoft Australia for a period of 12 months until the 7th March 2024, on any AvSoft Australia digital platform and for digital marketing, and thereafter, if and until requested by the entrant (in writing) that the image can no longer be used by AvSoft Australia for any further purpose beyond the date of request.
Prize details
There will be only one Winning Photograph.
Prize
One 64gb iPad Mini (wifi & cellular) AND, a one-year premium subscription to Avplan EFB – Total Prize Value: Approx$1300 (The Prize).
The Prize value is correct as at the date of the commencement of The Competition Period.
The Prize is not transferable or exchangeable.
Prize recipient (The Winner) must show valid ID to AvSoft Australia upon request.
The Prize shall be couriered or posted to The Winner within one week of the close of the Competition Period – at the Competition Organiser’s expense, and The Winner’s signature will be required to receive the Prize.
Decision final
In all matters relating to The Competition, including entry eligibility, acceptability, and the Winning Entry, all decisions of AvSoft Australia and AvPlan EFB and the judge(s) will be final and cannot be contested and no correspondence will be entered into to that effect. Judges’ feedback on submitted entries will not be provided.
Reserved Rights
The Competition Organiser reserves the right to alter the Terms and Conditions and to suspend, cancel, or alter the Competition at any time. The Competition Organiser unilaterally reserves the right to automatically disqualify any entrant and their entry(ies) at any time.
Governance
The Competition is ultimately governed by the laws of Victoria, Australia. As permitted by those laws, and to the extent of such, the Competition Organiser expressly disclaims any liability for damage, injury, or loss incurred by entry or entrant while participating in any way in, or having regard to, the Competition or receipt of The Prize.
